Sadly, the poor little guy was indeed dead. The other has spent much of the time in the food dish and now appears to have dug down. Fingers crossed for him! Thanks for all the responses!

Sorry. Forgot the question about the pools. I don't want to bother them to check for sure but I believe both should be able to fully submerge.
