Sorry, Collin, I think it's cruel. In the wild they live in huge rice patties, which are constantly refreshed by rain and filtered by the ground. Less than a gallon for 2 fish will go septic so fast you can't imagine. Not to mention there's almost no room to swim. They don't have a very good life, in my opinion. jojo7--I wouldn't put much in a 5 gallon. Maybe a betta and 3 other small fish. Depends on the filtration, but the usual rule of thumb is 1 gallon for each inch of fish. Bettas are usually 2 inches and black skirts or danios are usually 1 inch.

I know this post isn't about bettas (well, not exactly), and I don't want to argue, but here's the info I found on http://www.bettatalk.com : "Small cups are not included. Would YOU like to live in a closet? I think not. So why should your betta be any different! If you have a bunch of bettas, and not a whole lot of space, you might need to make those jars smaller. I do not recommend anything less than 1/2 gallon. With a 1/2 gal jar, a weekly water change should suffice, although twice a week is still best."And: "This is like the crème de la crème accommodation for bettas. Sorta like your resort hotel. A small tank, from one to 5 gal is set-up with a gentle filter, this set-up is the best you can provide your betta, but it might not be practical if you have a bunch of bettas."So, I believe that it may be OK for a breeder to keep bettas in a 1/2 gallon jar, since anything else would be impractical, but I think pet bettas should be kept in nicer accommodations. I have a betta-hex that I use when I clean the bettas' main tanks, I don't think it's even a gallon (maybe 1/2 gallon? I haven't used it in a while), so if there were 2 in it, that would be less than 1/2 gallon each. Everybody is a free moral agent and can choose to keep their pets as they please, but I wouldn't keep any fish in less than a gallon each. You wouldn't keep hermies in a KK for their whole lives, would you? Even if they seemed to be doing well, you'd know it's just not good to make them live in something so small. That's the last I'll say on the betta subject.
